1. Applicability
In these Terms and Conditions the "Company" or "Us" means Allegro Events Pty Ltd ABN 69 615 247 731 ACN 615 247 731 t/a Piano Hire Australia and the "Hirer", "you" or "your" means the individual or company hiring the piano from us.
These terms and conditions, in conjunction with the information supplied by you in the booking form, constitute the legally binding agreement ("Agreement") between us and you with regard to hiring of the piano.
2. Payment Terms
All payments must be made through the website, using our payment gateway, Stripe.
100% of the Hire Investment is payable upon booking in order to secure the piano.
Where your booking or agreed quote includes a Refundable Security Deposit, $500 is payable upon booking to cover any damage caused to the piano. No security deposit is payable where your booking or agreed quote shows a $0 deposit. After the piano is collected in its present condition (contract date), fair wear and tear excepted, the Refundable Security Deposit will be returned to you within 24hrs, less the cost of any repairs required to rectify damage to the piano.
The Hire Investment includes delivery and collection of the piano and may include professional tuning of the piano on the day of delivery. Additional delivery, collection and hire charges will apply if no-one is available at the Delivery/Collection address to facilitate delivery or collection of the piano at the agreed times.
3. Extending or Reducing the Hire Period
Subject to piano availability, the Hire Period may be extended before or after delivery of the piano, following consultation with the Company and payment in advance of an additional hire investment.
Once a booking is made, the whole of the Hire Investment is non-refundable, however arrangements can be made to collect the piano early if required.
4. Condition of the Piano
The piano will be inspected upon delivery and, where on-site tuning has been booked, tuned at the Delivery/Collection Address on the day of delivery.
Acceptance of the piano by the Hirer on the day of delivery deems the Hirer’s acceptance of the piano’s condition as in good working order and free of any damage.
The Company will maintain the piano in good working order during the Hire Period, provided it is notified immediately of any problem. The piano may only be tuned, serviced, repaired or moved by an authorised representative of the Company.
5. Positioning of the Piano
The Hirer agrees to keep the piano in its possession at the Delivery/Collection Address for the duration of the Hire Period.
The piano must be placed in a suitable position at the Delivery/Collection Address. The piano may not be placed in a basement, porch, garage or other harsh/humid environment that may cause damage to the piano.
The piano must not be moved from its position at the Delivery/Collection address without the Company’s written consent. Moving the piano must be done only by an authorised representative of the Company.
6. Liability for the Piano
The Hirer accepts full and sole liability during the Hire Period for damage to or loss or destruction of the piano from any and all causes including, but not limited to, neglect, misuse, accidents, theft, fire, water damage, storm damage, "acts of God," vandalism, malicious mischief and mysterious disappearance.
Should any damage or loss occur whilst the piano is in the Hirer’s possession, the Hirer must pay the Company for the lesser of the cost to repair the damage (if repairable) or the full market value of the piano. These costs are the Hirer’s responsibility regardless of whether the piano is returned to the possession of the Company or not.
7. Breach of this Agreement
If the Hirer breaches any term of this Agreement, the Company will have the right to take immediate possession of the piano and the Hirer will be liable for the Company’s costs of taking such possession and/or recovering the full market value of the piano including, to the extent permitted by law, court costs and attorney's fees and any other costs or fees.
8. General
The Hirer must not sell, mortgage, pawn, pledge, encumber or dispose of the piano. The Hirer must not assign, sublease or otherwise transfer its rights under this agreement.
This Agreement sets out the entire agreement between the parties with respect to the subject matter hereof. No oral statements or agreements will be valid or binding upon either party. This Agreement may not be amended, nor may any provisions be waived except in writing signed by both parties.
This Agreement will be governed by the laws of Victoria and the parties submit to the jurisdiction of the courts of Victoria.
